1. Description of the Service

Allergy Detective AI is an informational and organizational tool that helps users log symptoms, exposures, foods, products, activities, environmental factors, and medications, and then uses AI-assisted analysis to identify potential patterns and possible triggers. 2. Eligibility and Accounts

You must be at least 18 years old to create and own an Allergy Detective AI account. A parent or legal guardian may create and manage profiles for minors under their care. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep your information current.

You may create profiles for family members within your account, including minors under your care. You are responsible for all data entered into these profiles and for ensuring you have the authority to log health-related information on behalf of those individuals. Allergy Detective AI is not intended for minors to independently create accounts.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any law or regulation
• Attempt to access another user's data or accounts without authorization
• Use the Service to replace professional medical advice, diagnosis, or treatment
• Input false, misleading, or harmful information
• Interfere with or disrupt the Service, its servers, or its security features
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell, sublicense, or redistribute access to the Service without our written permission

4. AI-Generated Information

The Service uses artificial intelligence to analyze your logged data and generate potential pattern observations, possible trigger suggestions, cross-reactivity observations, and watch list recommendations. You acknowledge and agree that:

• AI-generated analyses are observational and organizational in nature
• AI-generated content may be incomplete, inaccurate, or misleading
• AI-generated content does not constitute medical advice, diagnosis, or treatment
• You must not rely on AI-generated insights as a substitute for professional medical evaluation
• You are solely responsible for any decisions or actions you take based on AI-generated content
• We do not guarantee that any AI analysis will identify all, or any, of your actual triggers

Our systems include automated safety checks designed to flag content that may involve medical advice or potentially dangerous recommendations. However, these checks are not perfect, and you must exercise your own judgment.

5. Your Content and Data

You retain ownership of all health-related information, photos, notes, and other content you submit to the Service ("Your Content"). You grant us a limited license to use Your Content solely to provide the Service to you, including processing it for AI analysis, generating reports, and storing it securely.

You are responsible for the accuracy of Your Content and for ensuring you have the right to log health-related information about any family member profiles you create.

6. Subscriptions and Billing

7. Intellectual Property

The Service, including its design, features, algorithms, and branding, is owned by EXCELSIA GROUP LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

Your Content remains your property. AI-generated analyses are provided to you for your personal use and may not be redistributed or commercially exploited.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• AI-generated analyses will be accurate, complete, or reliable
• Any defects or errors will be corrected
• The Service will identify your actual triggers or produce any specific results

9. Limitation of Liability

To the fullest extent permitted by law, EXCELSIA GROUP LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service, including but not limited to:

• Any reliance on AI-generated analyses or recommendations
• Any decision to start, stop, or modify a medication, diet, or treatment
• Any delay in seeking professional medical advice
• Any data loss or unauthorized access to your account

Our total aggregate liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless EXCELSIA GROUP LLC and its affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ends, and we may delete your data in accordance with our Privacy Policy.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in St. Lucie County, Florida.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
